Lowell graduated from Harvard College (1843) and the Law School (1846). From 1856 to 1860 he edited the Monthly Law Reporter in which he criticized the Dred Scott decision. In 1865, President Lincoln appointed him United States district judge for Massachusetts and in 1878 he became circuit court judge for the first circuit focusing on common law and patents. Benjamin Franklin Butler was born in Deerfield, New Hampshire, the sixth and youngest child of John Butler and Charlotte Ellison Butler. His father served under General Andrew Jackson at the Battle of New Orleans during the War of 1812 and later became a privateer, dying of yellow fever in the West Indies not long after Benjamin was born.
